What is this procedure for?
Webosa provides hosting for our customers' websites. We do not ourselves determine what content our customers put online, nor do we check websites in advance. Even so, we take our responsibility seriously: if you come across unlawful or criminal content on a website hosted by Webosa, you can report this to us via this Notice & Takedown procedure.
This procedure describes how to submit a report and how we handle it. In doing so we follow the Dutch Notice-and-Takedown code of conduct and the requirements that the European Digital Services Act (DSA) imposes on hosting services, including an accessible reporting point and a reasoned response to your report.
When do you submit a report?
A report is intended for content that is manifestly unlawful or criminal, for example:
- child sexual abuse material;
- incitement to hatred, violence or discrimination;
- fraud, phishing or the distribution of malware;
- infringement of copyright or other intellectual property rights;
- breach of privacy, slander or libel.
Are you in doubt as to whether something is unlawful, or does it concern a difference of opinion about the content of a website? In that case, please first contact the owner or administrator of the website in question directly.
How do you report content?
Send your report via our contact form. In any event, state:
- the exact URL(s) of the content you wish to report;
- a clear description of what is unlawful or criminal about it;
- why you consider it to be unlawful (and, if applicable, which right you are invoking);
- your name and contact details, so that we can reach you about your report.
The more complete your report, the sooner we can assess it. We cannot always process incomplete or unclear reports.
How do we handle your report?
After receipt, we assess your report as quickly as possible. In doing so, we proceed as follows:
- Assessment. We look at whether the report is sufficiently specific and whether the content appears to be manifestly unlawful or criminal.
- Referral where possible. If the unlawfulness is not evident, we may ask you to resolve the matter with the website owner or through the courts. We do not act as a judge over a substantive dispute.
- Contact with the customer. Where possible, we give our customer the opportunity to amend or remove the content themselves.
- Measures. If content is manifestly unlawful or criminal, we may make it inaccessible or suspend the service in question.
We inform you about the outcome of your report.
Urgent cases
If the content is very serious, such as child sexual abuse material or an acute safety risk, we act with priority and may make the content inaccessible immediately. Where necessary, we report criminal offences to the competent authorities.
Objection or counter-notice
Are you a Webosa customer and has your content been made inaccessible following a report while you believe this to be unjustified? In that case, please contact us. We will explain our decision and consider together whether the content can be restored.
No indemnification
Handling a report does not mean that Webosa acknowledges liability for the reported content. We act solely as a hosting provider and assess reports carefully and reasonably.
